What Does NZ Law Require for Pool Fencing?
Pool safety in New Zealand is governed by Section 162C of the Building Act 2004 and NZ Building Code Clause F9. This replaced the old Fencing of Swimming Pools Act 1987, which was repealed on 1 January 2017. All residential pools deeper than 400mm must be enclosed by a compliant barrier that prevents unsupervised access by children under 5.

Key requirements include:
- Minimum barrier height of 1.2 metres
- No gaps larger than 100mm
- Self-closing, self-latching gates that open away from the pool
- Outside latch must be at least 1,500mm above ground level
- No climbable objects within 1.2 metres of the fence on the outside

What Is a Council Pool Inspection?
Every pool in New Zealand must be registered with your local council and is subject to inspection every three years. In Tauranga, inspections are carried out by Tauranga City Council and cost $165 per inspection.
An inspector will check:
- Fence height and gap compliance
- Gate operation, self-closing and self-latching
- Latch height and accessibility
- Condition of the glass and hardware
- Whether any furniture or structures nearby could assist climbing
Failing an inspection results in a notice to fix. You typically have three weeks to rectify issues before a re-inspection. Serious safety concerns can result in a 48-hour reinspection requirement.
Frameless vs Semi-Frameless Pool Fencing
Frameless glass pool fencing uses thick toughened glass panels held in place by ground-mounted spigots. No top rail. Clean, unobstructed views of the pool. The premium option and the most popular in Tauranga.
Semi-frameless pool fencing uses posts at regular intervals with glass panels between them. A top rail runs the length of the fence. Still looks great, slightly more affordable, and offers an additional structural reference point.
Both systems use AS/NZS 2208 safety glass and both are fully compliant with NZS 8500 when installed correctly.
